Real Estate Law

Real Estate Law is a branch of law that regulates the ownership, use, transfer, lease, title deed transactions and legal issues related to immovable property (real estate). This branch of law examines and regulates the legal status of immovable properties such as land, buildings, flats and plots of land and the relations related to these properties.

The main subjects of Real Estate Law are as follows:

1. Property Right: Property refers to the rights that a person has over a piece of real estate. Real estate law regulates the rules regarding property rights and examines issues such as transfer of ownership, limitations, inheritance.

3. Mortgage and Pledge Law: It regulates the rules to be applied in case of mortgages and pledges on real estates. This means using a good as security for a debt.

4. Rent Law: Includes provisions related to the lease of immovable property. It regulates issues such as lease agreements, rent, rent increases.

5. Zoning Law: Regulates land use plans, zoning status, building permits and similar issues. Regulates the use and development of real estate.

6. Land Registry Cancellation and Registration Cases: Examines the legal processes filed for the correction or cancellation of land registrations.

Real estate law often varies depending on a country’s local laws, title deed regulations and zoning plans. Real estate purchase and sale transactions, inheritance, mortgages are important areas of real estate law.
